Please read our terms and conditions carefully before using mocycle.com (the "Website"). By using and making purchases from our website, you agree to the terms described below. As the terms are continuously updated (to reflect, for example, technological changes, our business model, our system capabilities, or relevant laws and regulatory requirements), we recommend reviewing this page regularly to be aware of any changes we may have made regarding the terms.

We strive to avoid any errors on the website, but the information, text, images, graphics, video and audio clips, and other web services may occasionally contain inaccuracies, be incomplete, or incorrect. In such cases, to the extent permitted by law, we cannot be held liable for any damages resulting from such errors, unless such damage is the result of our gross negligence or intentional misconduct.

Order

At what point in the ordering process are you bound to your purchase?

You are bound to your purchase the moment a confirmation appears on your screen. The order will be double-checked and approved by the company before shipping, if something is suspicious the order will be placed on hold.  Please refer to "Returns, Right of Withdrawal, and Complaints". The confirmation displayed on your screen is an automated acknowledgment that we have received your purchase. However, this confirmation does not mean that we have accepted your purchase, and we reserve the right to refuse your purchase after you have received the automated confirmation. If we approve your purchase, you will receive an email from us confirming that we have accepted your order (order confirmation). The agreement between you and us will be valid from the time the order confirmation is sent. If you have provided incorrect information when placing your order, please contact us, and we will be happy to assist you. However, always make sure to review your purchase before completing your order. Before finalizing the purchase, you have the opportunity to edit all the information you have provided, such as the delivery or billing address, credit card information, as well as modify or remove items in your shopping cart.

We cooperate with Shopify Payments and Nets Easy Checkout. You will pay in your country's currency.

Credit Card Verification Number

To ensure your security and prevent fraud, you will be asked to provide your card's verification number (CVV) when paying with a credit card. You can find the three-digit number on the back of your credit card. It is usually located to the right of your credit card number.

Payment Processing

If you place your order using a credit card, the payment will be deducted from your bank account once your order is verified.

If you place your order using PayPal, real-time bank transfers, iDeal, or a debit card, the payment will be deducted from your account upon order confirmation.

If you place your order using Klarna, your payment will be deducted from your account once you have paid the invoice.

Order Security

We use the Security Socket Layer (SSL) protocol, which is one of the most secure systems for online orders. SSL enables the encryption of your information, such as your name, address, and credit card details. Your information will be encrypted from the moment you enter it, and your personal information will not be stored on a public server. This means that the information transmitted between you and our website cannot be read if intercepted by someone else. The SSL system provides authentication, assuring your browser that your data is being sent to the correct and secure server; encryption, encoding all data so that only the secure server can read it; and data integrity, verifying that the transmitted data has not been altered.

Prices, VAT, and Fees

Our prices and fees may be subject to change due to circumstances beyond our control, such as significant fluctuations in raw material prices, currency changes, or amended VAT rates. All prices include VAT at a rate of 25%. In the event of a change in VAT, we reserve the right to adjust our prices and fees accordingly.

Shipping Fee

A shipping fee will be calculated based on the customers location and added when you purchase one or more of our products.

Delivery

Once you have placed an order, we will send it to our suppliers to be included in the next production batch. When the product is ready and delivered to us, we will ship it to you. We are not responsible for the package arriving before or on the specific month or date indicated when selecting the delivery option. It is an estimate only.

Regular Mail

Delivered directly to your mailbox as a parcel or sent to your local post office.

Product Inspection

Please note that you assume the risk for the products you have ordered once the delivery is completed. Do not accept the shipment if the packaging appears to be damaged. Aside from your rights and remedies under mandatory law, you are responsible for inspecting your products for any damages and notifying us of any complaints. In the case of delivery of defective products or if the order does not correspond to your purchase, you have the option to return the defective product. We will refund you the purchase price and any delivery costs once we have processed your return. You also have the right to keep the defective product and request a discount on the price.

Pre-Order 

  1. Pre-Order Definition: Pre-ordering allows customers to reserve products before they are available for general sale. By placing a pre-order, you agree to purchase the product upon its release.

  2. Payment: A full payment is required at the time of placing the pre-order. This payment guarantees your reservation of the product.

  3. Delivery: Estimated delivery dates are provided at the time of the pre-order. While we strive to meet these dates, they are subject to change based on production and supply chain factors. Customers will be notified of any significant delays.

  4. Cancellation and Refunds:

    • Customers may cancel their pre-order within 14 days of placing it for a full refund.
    • After 14 days, cancellations are not guaranteed and are subject to our discretion based on production status.
    • If we are unable to fulfill the pre-order due to unforeseen circumstances, a full refund will be issued.
  5. Product Changes: The product specifications, design, and features may change between the pre-order date and the delivery date. 

  6. Communication: By placing a pre-order, you agree to receive communication from us regarding the status of your order, including updates on production, shipping, and any changes to the expected delivery date.

  7. Shipping and Handling: Pre-orders will be shipped as soon as the products are available. Shipping costs and handling fees will be applied at the time of the pre-order.

  8. Liability: We are not liable for any damages or losses arising from delays in product availability or delivery. Our liability is limited to the refund of the pre-order payment in cases where the product cannot be delivered.

  9. Acceptance of Terms: By placing a pre-order, you acknowledge that you have read, understood, and agree to these terms and conditions.

Right to withdraw

According to applicable legislation, you have a 14-day right of withdrawal. The right of withdrawal is valid for 14 days from the day you received your item, or received the last item in an order where the items are delivered separately. With a few exceptions, you have the right to open the packaging and examine/test the purchased item, but only to the extent necessary to determine its characteristics and functionality.

If you wish to exercise your right of withdrawal, you must clearly notify us within 14 days. You can notify us via the return label, email, or any other medium that we have access to. When contacting us, clearly state that you wish to exercise your right of withdrawal, and we recommend providing your customer number, order number, and other relevant information in the message to avoid errors and delays. If you contact us by email, you will receive a confirmation that your email has been received shortly. If the deadline falls on a Saturday, Sunday, or public holiday, it is extended to the next business day. You then have 14 days to return your order. To facilitate the exercise of your right of withdrawal, follow the return instructions found in your delivery.

Return your unused item with all tags intact in its original packaging. If the packaging is unusable, you can use equivalent packaging. Ensure that the item is well-packaged to protect it during transportation. Keep your return receipt until you receive confirmation from us that your return has been processed, as it serves as proof of your return shipment. By returning the item within the deadline, you do not need to inform us in any other way unless you choose to do so.

If you exercise your right of withdrawal, we will refund you the price you paid. Please note that we do not offer reimbursement for delivery and return costs.

The refund will be made as soon as possible and no later than 14 days from the date we received your notice of withdrawal. However, we have the right to delay the refund until we have received the returned item. If your handling of the item has caused a depreciation in its value, or if the original packaging is missing or damaged, a deduction for the depreciation may be made. The deduction will be assessed on a case-by-case basis. The refund will be made using the same payment method you used for the order. If the refund is made via debit/credit card, it may take a few extra days for the funds to appear in your account due to the bank's processing time.

Return of Defective Products

We work hard to ensure that our products are of the highest quality and are delivered to you in perfect condition. If you discover that a delivered product is damaged, faulty, or has any deviations from your order, you have the option to return the defective product. We will refund you the purchase price as well as any delivery costs once we have processed your return. You also have the right to keep the defective product and request a price reduction. Please note that products that are damaged due to wear and tear are not considered faulty. Furthermore, claims regarding defective products should be made immediately upon discovering the fault. Notice of defective products submitted within two months of discovering the fault or damage is considered within the timeframe, although a longer period may apply for certain cases as required by law. Please contact us, and we will arrange the pickup of the product. If you would like to make another order, we are happy to assist you. Customers covered by Swedish law have the right to return the product within 36 months.

Please note that such a claim requires that you have not used the products in an improper manner and that the product is not defective as a result of this.

Incorrect Items

There may be instances where the wrong item is shipped for delivery. If you experience this, we sincerely apologize. Please contact our customer service team, and they will assist you with a new order for the correct item, as well as arrange for the pickup of the incorrect product.

Applicable Law

Without limiting your rights as a consumer under the laws of your country, these terms and conditions, any disputes or claims arising from them, as well as the use or shopping on the website, shall be governed by Danish laws.

Our Right to Revise Our Terms and Conditions

We reserve the right to revise and amend the terms and conditions over time. Your order will be subject to the policies and terms in effect at the time you place orders with us, unless any change to those policies or terms is required by law or governmental authority (in which case it will apply to orders previously placed by you). If we make changes to our policies or terms after you have completed your purchase but before we have sent the order confirmation to you, we will notify you of this. If you do not inform us that you accept these new policies or terms within seven working days, we will cancel your purchase and notify you by email.

Force Majeure

Mo'cycle is exempt from liability for failure to fulfill certain obligations under these Terms and Conditions if the failure is due to circumstances beyond our control and if the circumstances prevent, hinder, or delay performance. Circumstances beyond our control include actions or omissions by authorities, new or amended legislation, labor disputes, blockades, fires, floods, sabotage, or major accidents. Force majeure also includes government decisions that adversely affect the market and products, such as decisions regarding warning labels, sales bans, and more, or an abnormal market decline.
